Abhishek Bachchan’s personality rights SECURED by Delhi HC, court orders REMOVAL of misused content
The Delhi High Court has ruled in favor of Aishwarya Rai Bachchan and Abhishek Bachchan, protecting their personality and publicity rights from unauthorized exploitation.
Actress Aishwarya Rai Bachchan recently filed a petition in the Delhi High Court, in which she demanded protection of her personality and publicity rights. In this petition, a request was made to block such websites, remove illegal content and fake images created by AI. It was also said that her name and identity are being misused for commercial advantage and being presented in a fake manner. This step was taken especially against obscene and misleading photos and videos created by AI. The court ruled in favor of Aishwarya and ordered to stop the misuse of her identity.
Abhishek Bachchan also got legal protection
After Aishwarya, actor Abhishek Bachchan also filed a petition to protect his personality and publicity rights. The court also gave him relief and admitted that his name, photo and signature were being used without permission. Justice Tejas Karia said on Friday that the attributes related to Abhishek’s identity and professional image are being misused through AI and websites. He said, “These attributes are linked to the plaintiff’s professional work and associations in the course of his career. The unauthorised use of such attributes has the effect of diluting the goodwill and reputation associated with him.”
Strict comment of the court on Aishwarya case
The High Court made it clear that despite being a public figure, one’s identity and personal rights cannot be violated. The image of artists like Abhishek and Aishwarya is linked to their career and work. In such a situation, any kind of unauthorized use harms their hard work and image. The court said, “The balance of convenience lies in favour of the plaintiff and if an injunction is not granted in the present case, it will lead to an irreparable loss or harm to the plaintiff and his family, not only financially but also with respect to his right to live with dignity.”
